Thank you for visiting our website! Your privacy is important to us. It is so important that we dedicated an entire page to it. This policy explains the what, how, and why of the information we collect as described in below (“Policy”). It also explains the specific ways we collect, use, disclose, transfer, and secure  that information as well as the privacy rights you have. We take your privacy extremely seriously, and we never email addresses or other personal information. 

The Federal Trade Commission (FTC) has investigatory and enforcement authority over Movemedical’s compliance with privacy policy requirements as they pertain to any related privacy certifications. 

Movemedical complies with the EU-U.S. Data Privacy Framework (“EU-U.S. DPF”), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (“Swiss-U.S. DPF”) as set forth by the U.S. Department of Commerce.  Movemedical has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (“EU-U.S. DPF Principles”) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF.  Movemedical has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (“Swiss-U.S. DPF Principles”) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF.  If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern.  To learn more about the Data Privacy Framework (DPF) program, and to view our certification, please visit Data privacy framework website. 

This Policy applies to the processing of Personal Information (as defined below) that Movemedical obtains from Movemedical customers (“Customers”) as well as visitors to our website and users of our services and products. All Movemedical employees who handle Personal Information are required to comply with the principles stated in this Policy. 

COLLECTION OF PERSONAL INFORMATION 

When you use our services or websites, you may be asked for personally identifiable information or data such as your name, address, date of birth, email address, telephone number (“Personal Information”). By giving us such information, you consent to our using it in the manner described in this policy. You may withdraw your consent at any time by emailing us at privacy@movemedical.com. We will return or destroy your personal information within five days of receipt of your withdrawal of consent. Cookie information, pages you have requested, and your IP address may also be recorded by us and/or third parties from your browser as set out in this policy. 

USE OF PERFORMANCE DATA 

Movemedical will use performance data, including performance statistics and other similar data (“Performance Data”) uploaded to our websites. Movemedical may use such Performance Data in any way, including, but not limited to, using, editing, altering, reproducing, publishing and/or distributing the Performance Data for any purpose, commercial or otherwise, provided that such Performance Data is stripped of all personally identifiable information. 

USE OF PERSONAL INFORMATION 

We use Personal Information to allow us to process your requests, provide access to privileged areas of the services or websites, send out newsletters, personalize your visit to our websites, personalize your use of our products, comply with legal requirements, and enable us to improve the products and services we offer. We may occasionally carry out market research and send you details of services and offers that we think may be of interest to you. If you do not wish to receive such information, please e-mail privacy@movemedical.com or, alternatively, when we send you an e-mail, it will contain a provision for you to opt out of receiving any further information from us. 

COOKIES 

Cookies are small data files that a website you visit may save on your computer or handheld device that usually includes an anonymous unique identifier. Our websites may use cookies for user authentication, keeping track of your preferences, promotional campaigns, tracking our audience size and traffic patterns, and in certain other cases. We may include small graphic images in our email messages and newsletters to determine whether the messages were opened and the links were viewed. Third-party advertisers may also create and access cookies, which will be subject to their privacy policies – we accept no responsibility or liability for the use of such third parties’ cookies. SECURITY 

All security on our websites is treated seriously. Where applicable, we undertake security steps, including use of SSL technology to protect data transmissions. However, this is not a guarantee that such data transmissions cannot be accessed, altered, or deleted due to firewall or other security software failures. RIGHT TO ACCESS PERSONAL INFORMATION 

Individuals have the right to access, modify, remove, or add to the Personal Information about them is included in our databases and to ensure that such Personal Information is accurate and relevant for the purposes for which Movemedical collected it. Individuals may review their own Personal Information stored in the databases and correct, erase, or block any data that is incorrect, as permitted by applicable law and Movemedical policies. Upon reasonable request and as required by applicable privacy laws, Movemedical allows individuals access to their Personal Information, in order to correct or amend such data where inaccurate. Individuals may edit their Personal Information by contacting Movemedical by email. In making modifications to their Personal Information, individuals must provide only truthful, complete, and accurate information. 

REQUESTS FOR PERSONAL INFORMATION 

Movemedical will track each of the following and will provide notice to the appropriate parties under law and contract when either of the following circumstances arise: (a) legally binding request for disclosure of the Personal Information by a law enforcement authority unless prohibited by law or regulation; or (b) requests received from an individual. If Movemedical receives a request for access to his/her Personal Information from an individual, then, unless otherwise required under law or by contract with a customer, Movemedical will refer such requests to the customer. Movemedical will endeavor to respond in a timely manner to all reasonable written requests to view, modify, or inactivate Personal Information. 

DISCLOSURES / ONWARD TRANSFERS OF PERSONAL INFORMATION 

Except as otherwise provided herein, Movemedical does not disclose Personal Information to third parties. Movemedical may provide Personal Information to third parties that act as agents, consultants, or contractors to perform tasks on behalf of and under our instructions. For example, Movemedical may store such Personal Information in the facilities operated by third parties. Such third parties must agree to use such Personal Information only for the purposes for which they have been engaged by Movemedical and they must either: 

1.    comply with the Privacy principles or another mechanism permitted by the applicable US data protection law(s) for transfers and processing of Personal Information; or 

2.    agree to provide adequate protections for the Personal Information that are no less protective than those set out in this Policy. 

Movemedical also may disclose Personal Information for other purposes or to other third parties when an individual has consented to or requested such disclosure. Please be aware that Movemedical may be required to disclose an individual’s personal information in response to a lawful request by public authorities, including to meet national security or law enforcement requirements. Movemedical is liable for appropriate onward transfers of Personal Information to third parties.

ENFORCEMENT AND DISPUTE RESOLUTION 

Movemedical commits to resolve complaints about your privacy and our collection or use of your Personal Information. Individuals with questions or concerns about the use of their Personal Information should contact us at: privacy@movemedical.com. If a Customer’s question or concern cannot be satisfied through this process Movemedical has further committed to refer unresolved privacy complaints, free of charge to the reporting individual, to an independent dispute resolution mechanism operated by JAMS, the largest private alternative dispute resolution (“ADR”) provider in the world. Through this mechanism you have the opportunity to invoke binding arbitration depending on the nature of your complaint.

We may update this Privacy Notice and its last updated date to reflect changes to our data protection and governance practices. If we propose to make any material changes, we will notify you by means of a notice on this page.  We encourage you to periodically review this page for the latest information on our privacy practices.
